In the Provisions Regarding Law Application in Cases concerning Patent Disputes from the Supreme People’s Court it provides that a maximum of RMB 500,000 in damages may be given where the loss incurred by the infringed or the benefit received by the infringer is difficult to determine, and no patent royalties can be referenced.
